Tickify Terms & Conditions of Sale

TICKIFY.IO PTY LTD (ABN 11 655 797 809) (“Tickify”) provides ticketing services, including the sale and distribution of tickets, as provider for the venue, promoter or person responsible for holding the relevant event (the “Seller”). In providing these services, Tickify owns and operates Tickify (the “App”) and Tickify.io (the “Site”).

Please read these Terms and Conditions carefully before purchasing a ticket. By purchasing a ticket from Tickify, you agree to be bound by these Terms and Conditions.

These Terms and Conditions relate both to the sale of tickets and attendance at events and apply to both the original purchaser and any subsequent ticketholders (“you”).

Variation to Terms and Conditions

Tickify may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after these Terms and Conditions have been updated.

Additional Seller Terms and Conditions

Each ticket is also sold subject to any additional terms and conditions of the Seller for the particular event (including their Conditions of Entry) (“Seller's Terms”). The Seller's Terms may be disclosed as part of the event information on Tickify's App and/or website at the time of purchase and are available from Tickify on request.

General Terms and Conditions

Tickify acts as provider for the Seller in the sale of all tickets. As such, except as specified in these Terms and Conditions, all claims in connection with tickets or events are the sole responsibility of the Seller and, except to the extent required by law (including the Australian Consumer Law), Tickify otherwise has no liability to you.

Without limiting other remedies, Tickify may limit, suspend or terminate the Tickify account of users who are acting inconsistently with these Terms and Conditions, including users who harass, threaten or abuse our employees or other users, or who act in an unlawful or inappropriate manner.

4. Pricing and Ticket Availability

4.1. Tickify sells tickets on behalf of Sellers and other third parties, which means Tickify does not determine ticket prices. Each purchase will attract a 5% service fee, exclusive of GST. All tickets are priced in currency related to your selected region.

4.2. Sellers may change prices at any time. Prices may vary for different ticket allocations, promotions, special offers, presale customers, and Sellers may adopt a flexible pricing model and adjust prices to reflect demand. Unless required by applicable law, you will not be entitled to a refund or credit if the price you paid was at any time before purchase less than the price you paid, or if the price of any other ticket is subsequently reduced after your purchase.

5. Refunds, Exchanges and Replacements

5.1. Event Cancellation, Rescheduling, or Relocation. If an event is cancelled, rescheduled or significantly relocated, your eligibility for a refund will be determined by the event organiser. Tickify will communicate the organiser's refund decision and facilitate refund processes where applicable. Unless otherwise notified, refunds do not include booking fees or other administrative charges, which are non-refundable.

5.2. Refund Requests and Deadlines. For cancelled events, refunds (excluding booking fees unless otherwise advised) are automatically processed to your original payment method. For rescheduled or relocated events where refunds are offered, requests must be submitted within two weeks after notification of changes, or by the rescheduled event date, whichever is later.

5.3. Refund Exclusions. No refunds are provided for changes in personal circumstances, adverse weather, dissatisfaction with the event, or tickets purchased through unauthorised resale channels. No refunds are provided for lost, stolen, or inaccessible tickets (replacement tickets may be provided at Tickify's discretion with proof of purchase and reasonable notice).

5.4. Event Interruption or Disruption. Refunds or partial refunds due to significant event interruption or disruption are at the sole discretion of the event organiser.

5.5. Handling of Ticket Proceeds. Tickify securely processes ticket payments via Stripe. Ticket proceeds are generally held securely by Tickify via Stripe until the event concludes. Tickify may at its discretion provide certain event organisers with early or custom payouts, in which case the organiser remains solely responsible for ensuring refunds are promptly issued to ticket holders if required. For refund enquiries, contact info@tickify.io.

6. Variations to Performances or Events

The Seller reserves the right to add, withdraw, reschedule or substitute artists, performers, teams or players and/or vary advertised programs, prices, venues, seating arrangements and audience capacity. This action does not constitute a refundable event.

7. Conditions of Entry

Admission to an event is subject to the Seller's Terms. In particular:

  • You may be denied entry or removed from an event where the Seller has reasonable grounds to do so, including if you are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of others.
  • If you arrive late, you may not be admitted until a suitable break in the event.
  • You may not be permitted to take cameras or other recording equipment (including mobile phones) into the event.
  • You may be required to submit to a search of your person and/or possessions before entering.
  • By attending the event, you acknowledge that you may be filmed and/or recorded and you give permission to the Seller and Tickify to use your image, likeness and voice in all media throughout the world for any purpose without compensation.
  • You agree to comply with all Government directions, orders and regulations relevant to attending live events.

8. Authenticity and Validity of Tickets

Entry to an event may be refused if the authenticity or validity of a ticket is questionable. Tickify has robust methods to verify ticket authenticity and can detect duplicated, fraudulent, or unauthorised tickets.

9. Resale of Tickets & Scalping

Tickets may not, without the prior written consent of Tickify and the Seller, be resold or offered for resale at a premium (including via online auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes. If a ticket is sold in breach of this condition, it may be cancelled without a refund and the ticketholder may be refused admission.

SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

10. Limitations on Number of Tickets Purchased

When purchasing tickets for a particular event you may be limited to a specified number. If you exceed the stated ticket limit, any or all of your orders and tickets may be cancelled without notice at Tickify's discretion, including orders associated with the same name, email address, billing address, or credit card number.

11. System Errors

While Tickify takes all reasonable care to ensure tickets are correctly priced and available for sale when intended, errors may occur. Tickify may cancel an order made as a result of any such error, although in the case of a pricing error Tickify will endeavour to contact you to give you the option of purchasing at the correct price.

12. Customer Errors

If an error on your behalf results in Tickify reprocessing a ticket transaction at your request, Tickify may charge you the actual costs incurred, including any chargeback or merchant fees charged by a third party.

13. VIP Packages

Tickify may sell tickets coupled with other offerings from Sellers such as VIP experiences, merchandise etc. Tickify cannot be held liable for the non-delivery of any goods or services coupled with tickets as we have no oversight over fulfilment or delivery of these packages. All claims about non-delivery of VIP packages must be taken up directly with the Seller.

14. Inquiries and Complaints

14.1. For inquiries or complaints regarding the sale and delivery of tickets, contact us at info@tickify.io.

14.2. For inquiries regarding staff and/or amenities at a venue or event, contact the venue management or Seller.

14.3. For inquiries regarding artist performance, sound, lighting or production quality, contact the Seller.

15. Data Security

15.1. When we process your order we collect your credit card and personal information in accordance with our Terms and Conditions and our Privacy Policy.

15.2. If you are concerned about using your credit card online, please contact us for assistance.

15.3. If you deny or dispute a charge made by us, please contact us immediately. We consider credit card fraud to be a serious offence and aim to prosecute each case to the fullest extent possible.

The images, text, logos and artwork contained within the App and the Site are copyright to Tickify and/or the relevant licensors. All rights are reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically or otherwise transmitting in any form or by any means in whole or in part is prohibited.

17. Disclaimer and Liability

17.1. You accept that the Internet is not always reliable and that system outages may occur.

17.2. Save to the extent set out in the Competition and Consumer Act 2012 (Cth) (including the consumer guarantees under Australian Consumer Law) or otherwise permitted by law, we will not be liable for any damages, direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your purchase of any tickets or your access to, or use of, or inability to use the App and/or Site and its content.

18. Choice of Law

These Terms and Conditions shall be governed by the laws of the State of New South Wales, Australia, but legal proceedings may be commenced in any Australian State or Territory.

19. Australian Consumer Law

Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law. Those consumer guarantees apply in addition to any other express warranties we provide.
